Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Urtour website, web app, and related services (the "Service") provided by Urtour ("Urtour", "we", "our", or "us"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old (or the minimum age required in your country) to use the Service. By using the Service, you represent that you meet this requirement and that you have the legal capacity to enter into these Terms.

2. Your Account

You sign in to Urtour using Google. You are responsible for maintaining the security of your Google account, for all activity that occurs under your Urtour account, and for keeping your account information accurate. Notify us promptly at support@urtour.info if you suspect unauthorized access.

3. Subscriptions, Trials, and Billing

  • Plans. Urtour Pro is offered on a monthly or yearly basis at the prices shown at checkout.
  • Free trial. New users may be offered a free trial. At the end of the trial, your subscription will automatically convert to a paid plan and your payment method will be charged unless you cancel before the trial ends.
  • Auto-renewal. Subscriptions renew automatically at the end of each billing period at the then-current price until canceled.
  • Cancellation. You can cancel at any time from the billing portal. Cancellation takes effect at the end of the current billing period; you keep access until then.
  • Refunds. Except where required by law, payments are non-refundable and there are no refunds or credits for partial periods, unused features, or downgrades.
  • Taxes. Prices are exclusive of taxes unless stated otherwise. You are responsible for any applicable taxes.
  • Price changes. We may change prices with reasonable advance notice. Changes apply to your next billing period.

4. Acceptable Use

You agree not to:

  • Use the Service for unlawful, harmful, harassing, defamatory, or infringing purposes.
  • Upload content depicting other people without their consent, or content you have no right to share.
  • Attempt to reverse engineer, scrape, decompile, or interfere with the Service or its underlying AI models, except as expressly permitted by law.
  • Use the Service to build a competing product, train another AI model, or resell access without our prior written consent.
  • Circumvent usage limits, share accounts, or use bots or automated means to access the Service.
  • Attempt to gain unauthorized access to other accounts or systems.

We may suspend or terminate your account if you violate these Terms.

5. Your Content

You retain ownership of the photos and prompts you submit ("Your Content"). You grant Urtour a worldwide, non-exclusive, royalty-free license to host, store, process, transmit, and display Your Content solely to operate, maintain, and improve the Service for you. You are responsible for Your Content and for ensuring you have all rights necessary to submit it.

6. AI-Generated Output

The Service uses generative AI to produce text, audio, and recommendations ("Output"). Output may be inaccurate, incomplete, outdated, or unsuitable for a particular purpose. You should independently verify any information before relying on it, especially regarding directions, safety, opening hours, prices, history, or legal, medical, or financial matters. Urtour does not guarantee the accuracy of Output and is not liable for decisions you make based on it.

Subject to your compliance with these Terms, you may use Output for your personal, non-commercial travel purposes. Output may be similar across users for similar prompts; we make no exclusivity guarantees.

7. Intellectual Property

The Service, including its software, design, branding, and content (other than Your Content and Output), is owned by Urtour and its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service subject to these Terms. All rights not expressly granted are reserved.

8. Third-Party Services

The Service relies on third-party providers such as Google (sign-in), Stripe (payments), and AI model providers. Your use of those services is governed by their own terms. We are not responsible for third-party services or content.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. URTOUR DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT OUTPUT WILL BE ACCURATE OR RELIABLE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, URTOUR AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO URTOUR IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD 100.

11. Indemnification

You agree to defend, indemnify, and hold harmless Urtour from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of or related to Your Content, your use of the Service, or your violation of these Terms or applicable law.

12. Termination

You may stop using the Service at any time and delete your account from the app or by contacting us. We may suspend or terminate your access immediately if you violate these Terms, if required by law, or to protect the Service or its users. Sections that by their nature should survive termination (including ownership, disclaimers, limitations of liability, and dispute resolution) will survive.

13. Changes to the Service or Terms

We may modify or discontinue the Service, in whole or in part, at any time. We may also update these Terms from time to time. Material changes will be communicated by email or in-app notice before they take effect. Your continued use of the Service after the effective date means you accept the updated Terms.

14. Governing Law and Disputes

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws principles. The parties agree to the exclusive jurisdiction of the state and federal courts located in Delaware for any dispute that is not subject to arbitration or required by law to be brought elsewhere. Nothing in these Terms limits any non-waivable rights you have under the laws of your country of residence.

15. Miscellaneous

These Terms are the entire agreement between you and Urtour regarding the Service and supersede any prior agreements. If any provision is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce any right is not a waiver of that right. You may not assign these Terms without our consent; we may assign them to an affiliate or in connection with a corporate transaction.
